摘要
《埃什嫩那法典》大约早于《汉穆腊比法典》半个世纪颁布,在两河流域法制史上具有重要地位,但相较后者而言,我国学术界对其研究缺乏应有的重视。从1948年高茨首次发表相关泥板后,迅速吸引了国际学术界的注意,多位该领域的杰出楔形文字铭文学家对其进行了释读,但对法典某些条款的恢复和理解各家观点并不完全一致。本文以楔形文字原文为基础对法典进行中文释读,并选取领域中几个权威译本,如高茨本、亚荣本和罗斯本为参照,同时在注释中注重与《汉穆拉比法典》相关条款进行比较。
Enactment of the Laws of Eshnunna is presumably about half a century earlier than that of the Code of Hammurabi.It is significant in the history of Mesopotamian laws,but comparing to the latter less importance has been attached on it by Chinese scholars.Since the clay tablets were first published by A.Goetze in 1948,it soon attracted attentions in the international academia,and some outstanding Philologists in the field have provided their own translations,but on restorations and interpretations of certain clauses they were not agreed with each other.This paper aims to provide a reliable Chinese version of translation from the original cuneiform documents,with the references and discussions on several highly recognized version in the field,such as by A.Geotze,R.Yaron,and M.Roth,and with comparisons to the relevant clauses of the Code of Hammurabi.
