论交通肇事逃逸——基于二元行为无价值论的路径分析

On Traffic Accident Escape:from the Perspective of Dualism of Conduct without Value

学界对于“交通肇事逃逸”的界定历来存在诸多争议,但目前各种观点并没有将交通肇事罪的规范保护目的与司法实际相联系,因而存在一定的片面性。遵循二元的行为无价值论的路径分析,交通肇事逃逸的规范目的不只是促使肇事者积极抢救被害人,更重要的是恢复被破坏的交通秩序,重塑规范的有效性,增强国民的安全意识与秩序观念,故应当将交通肇事逃逸解释为行为人明知自己交通肇事而不履行相关法律义务,进而给被害人的生命、健康造成危险或造成其他法益侵害危险的行为。

There has been a lot of controversy in the definition of"traffic accidents and escapes"in the theory.However,at present,various viewpoints do not link the normative protection purposes of traffic accidents with the judicial reality,so there is a certain error.Following the analysis of dualism of conduct without value,the normative purpose of traffic accidents and escapes is not only to prompt the perpetrators to actively rescue the victims,but more importantly to restore the destroyed traffic order,reshape the validity of the norms,and enhance the safety of the people.The"traffic accidents and escapes"should be interpreted as a behavior that the perpetrators of traffic accidents,knowing the occurrence of traffic accidents,do not fulfill his/her relevant legal obligations,thereby cause danger to the victim's life and health or causing other legal interests.
