论我国行政许可评价制度的完善

On the Legal Perfection of Administrative License Evaluation System in China

行政法对社会权属规范化的本质要求使行政许可制度在行政法制度中处于核心,而起到行政许可创设与监督作用的行政评价制度仍冷落僻远、少人问津,这导致我国当前行政许可评价制度在规范来源科学性与制度创制合法性方面远落后于时代需要,甚至产生了制度失衡。在建设"服务型政府"的行政效能改革背景下,优化与行政许可评价制度关联紧密的各行政机关、社会组织建设科学行政许可-评价二维结构,完善并形成事前、事中、事后行政许可评价法律体系,是建设"服务型"政府,实现国家治理能力现代化的必由之路。

The essential requirement of the administrative law for the standardization of social ownership makes the administrative license system at the core of the administrative law system, while the administrative evaluation system, which plays the role of the creation and supervision of administrative license, is still neglected, leading to the current administrative licensing evaluation system in China lags far behind the needs of the times in regulating the scientific source and the legitimacy of system creation, and even produces system imbalance. Under the background of the administrative efficiency reform of building a "service-oriented government", it is the only way to build a "service-oriented" government and realize the modernization of national governance ability to optimize the government institutions and social organizations at all levels that are closely related to the administrative evaluation system, to build a two-dimensional structure of scientific administrative license evaluation, and to perfect and form the legal system of administrative license evaluation before, during and after the event.
