中国特色社会主义进入新时代,对我国法治建设提出了新的要求,其中包括知识产权法治建设的要求。作为部门法理学范畴的知识产权法理学,是推进我国知识产权法治建设的重要理论武器。新时代中国特色知识产权法理具有自身特点和丰富内容。其中,知识产权法理学的内涵与定位、知识产权政策与发展、知识产权法的体系化和法典化、知识产权法律制度理性与价值追求、知识产权法律制度之有效运行、知识产权制度变革与发展、知识产权文化等尤为重要。中国特色知识产权法理学是当代中国知识产权法理论研究重大课题,值得深入研究。

China's socialist modernization has entered a new era,and new requirements have been put forward for the construction of the rule of law in China,including the requirements for the construction of rule of law in relation to intellectual property.Intellectual property jurisprudence,as a branch of jurisprudence,is an important theoretical weapon for advancing China's intellectual property rule of law.The intellectual property law with Chinese characteristics in the new era has its own characteristics and rich content.Among them are the connotation and positioning of intellectual property jurisprudence,intellectual property policy and development,systematization and codification of intellectual property law,rationality and value pursuit of intellectual property legal system,effective operation of intellectual property legal system,reform and development of intellectual property system,and intellectual property culture.The intellectual property jurisprudence with Chinese characteristics is a major topic in contemporary theoretical research on intellectual property law in China,and it is worthy of further study.
