论雇佣合同纳入民法典的路径及其必要性 被引量:1

On the Way and Necessity of Incorporating Employment Contract into Civil Code

摘要 随着社会经济的发展,对于“互联网+”,共享经济等许多新型用工关系的出现,以及传统型的私人保镖,家庭保姆,园林修剪员等没有纳入劳动合同的用工关系,如何定义和保护它们的权益,在如今的立法当中,尤其在刚刚颁布的民法草案中,仍然没有明确的定位。通过研究分析,雇佣合同的存在对于解决与保障此类问题具有重要意义。因此回顾雇佣合同的历史与分析其现实处境,厘清与雇佣合同相似的劳动合同与承揽合同的关系,探寻和借鉴西方国家关于雇佣合同的立法模式,立足于我国本土的实际情况,探究雇佣合同纳入民法典的路径及其必要性,明确雇佣合同的地位,规范和保护游离于法律所未涵盖的多种新型及传统的用工关系,为其提供法律依据。 with the development of economy and society,such“internet+”,sharing economy and so on have already appeared as new labor relations,and traditional private bodyguard,home carer,garden trimmer have not included into the labor contract.How to define and protect their rights?For they are not still fixed in today’s legislation.Through research and analysis,the existence of employment contract is of great significance to solve and safeguard such problems;So we should provide a legal basis by reviewing the history of the employment contract,analyzing its present situation,clarifying labor contracts and contracts of hired work that are similar to employment contracts,and drawing lessons from the legislative model of employment contract in western countries.Based on the actual situation in China,we should explore the approach and necessity of employment contract brought into civil code,clarify the status of the employment contract,regulate and protect new and traditional employment relationships that are not covered by law.
