Equity Protection of Public and Privacy Interests--Legal Reflection Based on COVID-19 Pandemic Prevention and Control

在维护公共权益与保障隐私权益之间如何寻找平衡点,一直是亟待解决的难题,这在2020年的新冠病毒肺炎疫情的防控中显得尤为突出;本文从我国该疫情防控中发生的个人信息泄露入手,聚焦公共权益的维护与隐私权益保障之间的权衡与博弈,分析协调这两种权益所应遵循的原则及目标,明确二者间的衡平保护问题,以期避免个人信息泄露的发生,以警示个人信息的泄露与滥用。

How to balance the protection of public and privacy interests has always been an urgent problem to be solved, which is particularly prominent in the COVID-19 pandemic prevention and control in 2020. This paper starts with the leakage of personal information during the COVID-19 pandemi cprevention and control in China, focuses on the game and banlance between public and privacy interests,analyzes the principles and objectives that should be followed, and finally identifies the equity protection between the two in order to reduce the occurrence of personal information leakage, and to warn the disclosure and abuse of personal information.
