摘要
国际标准必要专利领域的诉讼纠纷案件在近几年屡见不鲜,其诉讼的国际同步化趋势不断加强,中国企业也不可避免被卷入其中。由于标准必要专利诉讼裁判在各国呈现出不同特征,因此对该领域国际案件进行梳理和总结显得尤为重要。本文介绍和分析近三年国际标准必要专利领域FRAND费率之诉和反垄断之诉的典型案件,并对不同法域中侵权诉讼的禁令颁发条件进行对比和探讨,从而把握该领域的最新国际动向,为中国司法建设与企业维权提供借鉴。
Litigation disputes in the field of international standard essential patents have been common in recent years,and the international synchronization has continued to be strengthened,where Chinese companies are inevitably involved in it.The litigation of standard essential patents has presented different juridical characteristics in various countries,thus it is particularly important to sort out and summarize international litigation cases in this field.This article will introduce and analyze some typical cases of FRAND rate and antitrust lawsuits of international standard essential patents in the past three years,then compare and discuss the conditions for issuing injunctions for infringement lawsuits in different jurisdictions,so as to grasp the latest international trends in this field and provide a reference for Chinese enterpr ises and the judiciary.
