论裁判规则的基本含义及其功能

Research on Basic Meanings and Functions of Judgment Rules

当下学术界在享受“快餐式”裁判规则文章的同时,并未完全认同裁判规则的这一“江湖地位”,认为这仅是一技术性问题,并无理论性研究可言。为此,当下学术界乃至实务界对何谓裁判规则、裁判规则的生成机制如何、裁判规则具有何种功能等问题并不明确,也缺乏应有研究。基于合理性和科学性角度而言,裁判规则应当基于狭义视角来认识和处理,不应采广义的裁判规则。裁判规则具有生动性、超越性、创造性和参考性等特点,而且裁判规则具有还可以具体分为实体性裁判规则与程序性裁判规则、指导性裁判规则与参考性裁判规则、填补型裁判规则、细化型裁判规则与延伸型裁判规则等不同类型,裁判规则还具有弥补成文法的不足、发挥法官的能动性、填补法律的漏洞、实现同案同判等功能。

While the academic community enjoying the“fast food”judgment rules article,it does not fully agree with the status of the judgment rules.People regard it as a mere technical issue and think there is no theoretical research.For this reason,current academic circles and even the practical circles are not clear of what is the rule of the judgment,how the rules of the referee form,and what are the functions of the judgment rules.Therefore,people should do more research on it.Judging from the perspective of rationality and scientificity,the judgment rules should be recognized and dealt with based on a narrow perspective,and the general rules should not be adopted.The judgment rules are characterized by vividness,transcendence,creativity,and reference.The judgment rules can also be divided into substantive judgment rules and procedural judgment rules,guiding judgment rules and referential judgment rules,and padding judgment rules.There are different types of specified-type judgment rules and extended-type judgment rules.The judgment rules also have the functions of making up for the deficiencies of the statute law,exerting the judge’s initiative,filling the loopholes in the law,and achieving the same judgment of the same case.
