摘要
监察委员会的宪法地位决定了其在国家权力结构体系中的独立地位,与行政机关处于同一位阶使得其超脱行政诉讼被告的范畴。监察权不是几种权力的简单合并,而是优化整合成为一种新型的权力类型,不能简单地将行政监察权割裂适用,而应统一在《监察法》的规制内运行。《监察法》从对监察委员会及其监察工作人员的内外部监督、监察对象的申诉权利以及监察机关工作人员的法律责任等维度构建了全面的自我监督体系,使得行政诉讼监督已无必要。
The constitutional status of the Supervisory Commission determines its independent status in the national power structure system,and being in the same rank with the administrative organ makes it beyond the scope of the defendant in administrative litigation. Supervision right is not a simple combination of several powers,but a new type of power,which can not be simply separated and applied,but should be unified in the supervision law. The supervision law constructs a comprehensive self-supervision system from the perspectives of internal and external supervision of the Supervisory Commission and its supervisory staff,the right to appeal of the supervisory object and the legal responsibility of the supervisory staff,making the supervision of administrative litigation unnecessary.
