我国金融申诉专员管理机构行业主导模式的反思

Reflections on the Industry-dominated Model of the Management Bodies of Financial Ombudsmen in China Mainland

金融申诉专员的管理机构在其内部治理结构中处于核心地位。INFO网络认为金融申诉专员要实现“独立性,以确保公正原则”,须确保其管理机构不具有行业主导性。加拿大、新加坡、中国香港与中国台湾等国家与地区的金融申诉专员的管理机构均采用非行业主导模式,而我国金融申诉专员的管理机构均采用行业主导模式。要解决我国金融申诉专员机构运作不畅的问题,必须从管理机构的行业主导模式过渡到非行业主导模式,完善理事会与监事会的构成,科学地设置其职责,并保证其有效运作。

The financial ombudsman’s management body is at the core of its internal governance structure. INFO Network believes that to achieve "independence to ensure the principle of fairness", financial ombudsmen must ensure that their management bodies are not industry-dominated. The management bodies of financial ombudsmen in Canada, Singapore, Hong Kong SAR and Taiwan of China all adopt non-industry-dominated models, while in China Mainland all adopt industry-dominated models. To solve the problem of China Mainland’s financial ombudsman institutions’ poor operations, we must transition from the industry-dominated model of the management bodies to the non-industrydominated model, improve the composition of the council and the supervisory board, set up their duties scientifically, and ensure their effective operations.
