摘要
由于部分司法公开实践者在认知形态和价值衡量上的错误思维,当前司法公开工作呈现出知性"茫然"造成的感性"热闹"下的理性"偏失"样态,依然存在规范文件与司法现状的不适、制度设计与用户需求的差异以及运行效果与司法实践的失调等三大方面的隐忧。
Due to the erroneous thinking of some judicial transparency practitioners in cognitive form and value measurement,the current judicial transparency work presents a rational"deviation"under the emotional"noise"caused by intellectual"loss".There are three major concerns: inconsistence between regulatory documents and the status quo of the judiciary,differences in system design and user needs,and misalignment between operational effects and judicial practice.
