我国法院在线调解机制的运行现状与完善

The Operation Situation and Improvement of China s Court Online Mediation Mechanism

新冠肺炎疫情爆发以来,对旅游、房屋租赁与交通运输等多个领域造成冲击,由此引发大量民商事纠纷。各地法院暂停线下立案、开庭等审判工作,导致当事人无法及时推进案件诉讼进程,对传统诉讼调解机制也带来压力与挑战。鉴于此,各地法院积极利用在线调解平台“对症下药”,“零接触”化解纠纷,取得了显著效果,但一些问题也随之暴露出来。从实践层面看,各地法院在线调解平台存在重复建设现象,差异较大;在线调解过程中程序不规范、实际使用率较低。在人才方面,大多法院尚不重视职业化在线调解队伍的建设。针对暴露出的短板与不足,未来应提升法院在线调解机制的信息化、专业化程度,使法院在线调解机制在社会治理现代化中章显成效。

Since the outbreak of the Covid-19 epidemic,it has impacted on various fields,such as tourism,housing leasing and transportation,which has caused a lot of civil and commercial disputes.Local courts suspend offline filing,trial and other trial work,causes the parties to fail to advance the case litigation process in a timely manner,it also brings pressure and challenges to the traditional litigation mediation mechanism.Therefore,courts around the country actively use the online mediation platform to“administer the right medicine”and“zero contact”to resolve dispute,achieved remarkable results,but some problems are also exposed.Just now,the online mediation mechanism of the courts varies greatly,repeated construction is common.From a practical perspective,procedures are not standardized during online mediation,lower actual usage;most courts have not paid attention to the construction of professional online mediation teams.For exposed shortcomings and deficiencies,in the future,the informatization of the court s online mediation mechanism should be improved,degree of specialization,make the court online mediation mechanism effective in the modernization of social governance.
