摘要
法学教育对于国家法治人才的培养具有基础性和先导性的战略作用。法律硕士专业学位作为法学教育的重要组成部分,其为国家培养应用性法治人才的创设初衷,使其区别于法学硕士学术学位。然而,专业学位在现实中与学术学位的培养目标界限并不明晰,高校法学专业为教育便利及迎合学术成果绩效考核,使得二者的培养模式趋同于素质教育,且理论与实践割裂,教育目标脱轨,偏离了创设初衷。以岗促学是法律硕士教育与法律职业的衔接,对其进行探索将开辟法律硕士教育与法律职业协同创新的新领域。以岗促学作为国家应用型法治人才培养的核心驱动,是法律硕士教育的创新发展与法律职业诉求实现的重要抓手。也因如此,以岗促学为摆脱理论脱离实践、重构法律硕士课程体系提供了创新基点,将有助于重塑法治人才的培养格局。以岗促学作为从法律素质养成走向法律职业融通的模式创新,其生成将有赖于法律硕士教育目标理念的纠偏,以及机制引领的多元并举。
Law education plays a basic and leading strategic role in the cultivation of national legal talents.As an important part of law education,the professional degree of master of law is the original intention of training applied legal talents for the country,which makes it different from the academic degree of master of law.However,in reality,the boundary between professional degree and academic degree is not clear.For the convenience of education and to cater to the performance appraisal of academic achievements,the training mode of law major in Colleges and universities tends to be quality education,and the theory and practice are separated,and the education goal is derailed,which deviates from the original intention.Promoting learning by post is the link between legal master education and legal profession.Exploring it will open up a new field of collaborative innovation between legal master education and legal profession.As the core driving force for the cultivation of national applied legal talents,promoting learning by post is an important starting point for the innovative development of legal master education and the realization of legal professional demands.As a result,it provides an innovative basis for breaking away from theory and practice and reconstructing the curriculum system of master of law,which will help to reshape the training pattern of legal talents.As a mode innovation from the cultivation of legal quality to the accommodation of legal profession,the formation of post promoting learning will depend on the correction of the goal and concept of legal master education,as well as the simultaneous development of multiple mechanisms.
