摘要
法学本科教育对于实务技能的培养具有局限性,目标应当定位为培养合格的法律职业者"毛坯",此"毛坯"经过工作的历练才能成为一名真正的法律职业者.因而,法学本科教育对于学生实务技能的培养不能大包大揽,以有所为有所不为的态度承担起应该承担的职责,一方面着眼于分析表达技能的训练,另一方面克服或者避免舍本逐末之举,包括不放松专业知识的教学、专业实习不可"重形式而轻实质"、相关性课程开设不宜贪多求全等.
The undergraduate education of law has its limitations on the cultivation of practical skills,and it should aim to qualified“blank type”legal professionals,which can become real legal professionals based on practice experience.Therefore,the cultivation of practical skills can’t be absolutely undertaken by the undergraduate education of law,and should make clear its dos and don’ts.On the one hand,it should focus on skills training for analysis and expression;on the other hand,it should overcome or avoid some forms of misconduct,including neglecting the importance of professional knowledge,thinking much of formal reason than substantive reason in teaching practice of law,offering too many relevant courses,etc.
