论刑事二审庭前会议制度——基于S省C市裁判样本的实证考察

The Discussion of the Pretrial Conference System in Second Criminal Trial:An Empirical Investigation of the Judgment Sample of C City in S Province

刑事二审庭前会议制度有其特殊之处,分析S省C市中级人民法院2016~2017年审理的刑事案件,发现庭前会议制度在刑事二审实践中的运行情况较立法之期望状态差距较大,存在适用率过低等问题,实际的适用效果并不理想,这主要系实务中对二审庭前会议重视性不够、特殊性认识不足、功能理解不清所致。因此,应从以下几个方面对刑事二审庭前会议制度进行完善:(1)明晰庭前会议启动之审查判断要素,(2)优化庭前会议对二审庭审证据调查的准备效果,(3)明确刑事二审庭前会议的重要程序性作用。此外,实务中应注意避免因庭前会议之召开导致庭审程序错位的问题。

The criminal pretrial conference system has its special features.After analyzing the criminal cases heard by a city’s intermediate people’s court in 2016-2017,it is found that the operation of the pretrial conference system in the criminal second trial practice is far from the expected state of legislation.There are problems such as low application rate,and the actual application effect is not ideal.This is mainly due to insufficient attention to the pretrial conference of the second instance in practice,insufficient awareness of special characteristics,and unclear understanding of functions.Therefore,the criminal pretrial conference system should be improved in the following aspects:(1)Clarifying the elements of the review and judgment of the pretrial conference,(2)Optimizing the pretrial conference’s preparation effect for the second-trial trial evidence investigation,(3)Clarifying the important procedural role of the pretrial conference of the criminal second instance.In addition,in practice,care should be taken to avoid problems that lead to the misplacement of the court proceedings due to the pretrial meeting.
