人工智能出版物的立法思考——基于著作权法中作品的创造性 被引量:7

摘要 当前,人工智能出版物层见叠出,它不仅悄然改变着现实社会中人们的生活方式,也使我国现行著作权法不断受到挑战。到目前为止,我国多数学者囿于著作权法的法律框架探讨对人工智能出版物的保护模式,忽视了最为关键的著作权法保护人类作品的立法意图。文章从作品的创造性入手,揭示出作品创造性的本质,进而剖析人类作品与人工智能出版物的实质区别,指出人工智能出版物不应被视作现行著作权法规定的作品,最后探索对人工智能出版物的立法保护本旨,试图寻找出一条适合我国国情的人工智能出版物的法律保护路径。 At present,artificial intelligence publications are thriving.It not only quietly changes human lifestyle in the real society,but also continuously challenges our current copyright law.So far,most scholars in China have focused on the protection mode of artificial intelligence publications and their discussions are confined to the legal framework of copyright law,which ignores the most critical legislative intention of human works protected by copyright law.This article intends to start with creative works and reveal the nature of creative works,then analyzes the essential differences between human works and artificial intelligence publications.In the meantime,it also points out that artificial intelligence publications should not be considered as works under the current copyright law.Finally,it explores the purpose of the legislative protection of artificial intelligence publications to find a legal protection path for artificial intelligence publications which is suitable for our country's national conditions.
