在线诉讼的产生与实践改变了传统意义上的审理模式,为诉讼纠纷的解决提供了一种全新的思路。互联网法院在这一过程中发挥了不可或缺的重要作用,区块链技术、智慧司法等新兴技术也为在线诉讼的向好发展提供了强大的技术动力。但作为一种全新的“时代产物”,其运行过程中呈现出了不平衡、不充分的态势,出现了一定程度上的困境,因而探索较为可行的出路也十分必要。如在区块链存证平台方面设立一定的准入门槛和定期考核退出机制,从源头上保证其安全、稳定运行;针对异步审理模式对传统诉讼法理的削弱问题,应当从完善告知程序、建立自动繁简分流机制等方面予以完善,以此推动新兴科技同在线诉讼的良性互动与深度融合,形成二者“共同增长”的新业态。

The emergence and practice of online litigation has changed the traditional trial mode and provided a brand-new idea for the settlement of litigation disputes.The internet court has played an indispensable and important role in this process.Emerging technologies such as blockchain technology and smart justice have also provided strong technical momentum for the development of online litigation.However,as a brand-new“product of the times”,its operation showed an imbalanced and inadequate situation,and a certain degree of predicament appeared.Therefore,it is necessary to explore a more feasible way out.For example,if a certain entry threshold and a periodic assessment and withdrawal mechanism are set up on the blockchain certificate platform,it will ensure its safe and stable operation from the source.In view of the weakening of the traditional litigation jurisprudence by the asynchronous trial mode,it is necessary to improve the notification procedures.The automatic and simplified shunting mechanism has been improved to promote the positive interaction and deep integration of emerging technologies and online litigation,and form a new business form of“common growth”between the two.
