司法鉴定管理体制探索与研究

Exploration and Research on Judicial Authentication Management System

随着社会主义民主法制建设的高速发展和科学技术的不断进步,鉴定结论对于查明案件事实真相、辅助裁判起着越来越重要的作用。作为高度统一的科学和法律司法鉴定,由于行业主管部门缺乏行业管理,其科学性难以保证,司法鉴定质量必然会下降。当事人对司法鉴定意见存有疑虑,发生了大量鉴定和反复鉴定,司法鉴定证据作为司法审判服务失去了价值。笔者通过调研和查阅相关法律法规及文献,分析出在司法鉴定制度中的主要缺陷,并就行业管理对司法鉴定制度的立法与完善提出相应的举措。

With the rapid development of socialist democracy and legal system construction and the continuous advancement of science and technology,the identification conclusions play an increasingly important role in ascertaining the facts of the case and assisting the referee.As a highly unified scientific and legal forensic appraisal,due to the lack of industry management in the competent authorities of the industry,its scientific nature is difficult to guarantee,and the quality of judicial appraisal will inevitably decline.The parties have doubts about the judicial appraisal opinions,and a large number of large-scale appraisals and repeated appraisals have occurred.The judicial appraisal evidence has lost value as a judicial trial service.Through investigation and review of relevant laws,regulations and literature,the author analyzes the main defects in the judicial identification system,and proposes corresponding measures for the legislation and improvement of the judicial identification system.
