Comparative Study on the Latest Version of JCT Standard Construction Contract Conditions and FIDIC Civil Engineering Construction Contract Conditions

JCT合同条件不仅在英国本土得到广泛使用,也被很多英国以外的国家和地区所认可。从合同结构、第三方合同管理者的权限、付款程序和内容、材料设备运输中的风险分配、工程索赔、争端解决等方面对新版JCT《标准建造合同》和FIDIC《土木工程施工合同条件》进行比较研究,发现与FIDIC合同条件相比,JCT合同条件在合同管理者对承包商人员变动的干预权方面的规定更有利于业主,而在业主对承包商选择分包商的确定权、工程付款程序、材料设备运输中的风险分配等方面的规定更有利于承包商。

The JCT standard contracts are not only widely used in UK,but also widely accepted around the world.The paper makes a comparative study of the latest version of JCT Standard Construction Contract and FIDIC Civil Engineering Construction Contract conditions on the following aspects:contract structure,third party contract manager’s rights,payment procedures and content,risk allocation in the transportation of materials and equipment,claims,dispute avoidance and settlement.The study reveals that,compared with FIDIC contract conditions,JCT contract conditions are in favor of the owner in terms of right of intervention of the determination of contractor’s personnel,while in favor of the contractor in terms of selection of subcontractors,payment procedures,risk allocation in the transportation of materials and equipment,etc.
