摘要
国际海底区域矿产资源的勘探、开发和利用等活动对海洋环境造成的影响受到国际社会的广泛关注,海洋环境标准尤其是绩效标准是国际海底管理局近期迫切需要优先制定的重点内容。本文介绍了关于"区域"标准的逻辑,包括"标准"和"准则"的内涵及其法律地位、类型、制定的方法和流程等,"区域"环境调查的内容及国内外深海环境标准现状,并就我国如何更好参与"区域"环境标准制定提出建议。
The impact of the exploration, exploitation and utilization of mineral resources in the international seabed area on the marine environment has been widely concerned by the international community. Marine environmental standards, especially the performance standards, are the urgent priority for the International Seabed Authority in the near future. This paper introduces the logic of the "area" standards, including the connotation, legal status, types, working methodology and processes of "standards" and "guidelines", the content of the "area" environmental survey and the status quo of deep-sea environmental standards at home and abroad. It also puts forward suggestions on how to better participate in the development of "area" environmental standards in China.
