教育行政法治化视角下的高校创新创业教育

Innovation and Entrepreneurship Education in Colleges and Universities in the Perspective of Legalization of Educational Administration

依法治国进程中,教育行政权力导向模式将会逐步转变为教育行政法规导向模式。在创新创业教育领域中,加强行政法治化建设,可以有效均衡行政机关、高校、师生和其他利益相关方之间的权利边界,可以使行政机关的职权行使内容和行使程序得到合理约束,使高校办学自主权更加明晰,使创新创业教育的特色创新和可持续发展得到更好保障。过去20年中,行政机关高频使用行政政策,对创新创业教育的社会需要灵活回应;高效运用行政指导,对高校和其他主体实施柔性影响;适度采用行政检查,对探索中的争议做法包容试错,这些做法对高校创新创业教育中国特色的形成,发挥了很好的作用。但在创新创业教育的行政法律规范系统化建设和教育行政行为的规范化实施方面,仍有很大的提升空间。加快该领域教育行政法治化建设,对促进我国教育行政法治化水平的整体提升,具有积极的理论意义和现实迫切性。

In the process of governing the country according to law,the educational administrative poweroriented model will gradually change to the educational administrative regulations-oriented model.In the field of innovation and entrepreneurship education,strengthening the construction of administrative rule of law can effectively balance the power boundaries between administrative organs,universities,teachers and students,and other stakeholders,and can reasonably restrict the content and procedures of the exercise of powers of administrative organs,make the autonomy of colleges and universities more clear,and the characteristic innovation and sustainable development of innovation and entrepreneurship education are better guaranteed.Over the past two decades,administrative agencies have used administrative policies frequently,responding flexibly to the social needs of innovation and entrepreneurship education;using administrative guidance efficiently,and implementing flexible influences on universities and other entities;using administrative inspections appropriately,and being tolerant of controversial practices in exploration trial and error,these practices have played a very good role in the formation of the Chinese road of innovation and entrepreneurship education in colleges and universities.However,there is still much room for improvement in the systematic construction of administrative laws and regulations and the standardization of educational administrative behavior of innovation and entrepreneurship education.Innovative and entrepreneurial education has been a hotspot of social concern in recent years.Accelerating the construction of the legalization of education administration in this field has positive theoretical significance and practical urgency for the overall promotion of the level of legalization of education administration in China.
