法学视角下的生态利益,是环境利益的下位概念,是指生态系统对人类享受清洁空气、清洁水、优美景观、宁静生活等精神需要的满足。生态利益是环境法的应然法益,应受到环境法的全面保护和调整,但我国现行环境立法对生态利益的消极保护使得其尚未成为环境法的实定法益。在生态文明建设语境下,现行环境立法要通过明确生态利益的法益地位、建立专门的生态保护法、构建生态利益补偿制度和救济制度来完善对生态利益的保护。
