地方立法“地方特色”之检视--以浙江省设区市立法为例

A Review of the “Local Characteristics” of Local Legislation-taking the Legislation of Setting up Districts and Cities in Zhejiang Province as an Example

地方特色是地方立法的价值所在,也是衡量地方立法质量的重要标准。以浙江省设区市立法为样本进行考查,发现地方立法抄袭上位法、缺乏地方特色的现象仍普遍存在。为此,地方立法应坚持党的领导、发挥人大对立法的主导作用、健全第三方主体多元化参与立法机制、建立健全立法监督与问责制度,确保地方立法体现地方特色。

local characteristics are not only the value of local legislation, but also an important standard to measure the quality of local legislation. Taking the legislation of setting up districts and cities in Zhejiang Province as a sample, it is found that the lack of local characteristics is still common when the local legislation plagiarizes the superior law. Therefore, local legislation should adhere to the leadership of the Party,give full play to the leading role of the National people’s Congress in legislation, improve the mechanism of pluralistic participation of third-party subjects in legislation, establish and improve the system of legislative supervision and accountability, and ensure that local legislation embodies local characteristics.
