摘要
"大调解"资源动员与整合优势突出,是我国边疆、民族地区处置群体性纠纷事件的主要机制。其党政驱动、权力主导的运行模式与"稳"字当头、宁人息事的价值取向相叠加,导致该机制在实践中出现调处视阈狭隘、调处方式粗线条以及处置方案的拟定同质化等问题。肯·威尔伯的"象限""层次(阶段)"说对此提供了深刻观照。参考其朴素的理论路径,有助于均衡提升边疆、民族地区群体性纠纷"大调解"工作体系的运作效率与社会效果。
At present,"Grand Mediation"is the most universal model dealing with the mass disputes in Chinese ethnic frontiers.Its huge advantage in the mobilization and integration of resources in disputes resolution is affected greatly by its short-sighted value orientation and the resulting problems,such as the lack of the perspective of integrity and pertinence,preferring for materialized resolution and the ignorance of clarifying the moral levels of disputing parties.Therefore,the model is found to be low in both fairness and working efficiency.The U.S.philosopher Ken.Wilber had put forward a valuable analytic perspective and methodology in his integral theory which could be drawn on to apply in mass disputes resolution practice as an alternative way out,especially its sub-theory of Quadrants and Levels,which could be beneficial to resolve the aforementioned substantial problems,and further enhance the institutional efficiency and the social effect of the current"Grand Mediation"institution.
