“一带一路”背景下跨境电子商务运输法律体系构建的探析

Analysis on the Construction of Cross-Border E-Commerce Transportation Legal System under the Background of the“Belt and Road”

“一带一路”为国内经济的发展创造了无数可能,带动沿线经济增长的同时,还创造了国际上的奇迹。针对“一带一路”跨境电子商务运输采取一定的法律体系管理,以此作为准则规范“一带一路”,有很必要的意义。在这样的背景下,本文从《鹿特丹规则》出发,考虑到该规则的出现是以海上运输电子商务为背景发展起来的法律体系,充分借鉴其优势的同时,从现有的经济方面出发,探究我国跨境电子商务运输法律体系的构建和发展。

The“Belt and Road”has created countless possibilities for the development of the domestic economy,not only drive the economic growth along the belt and road,but also created international miracles.It is of great significance to adopt certain legal system management for the“Belt and Road”Initiative cross-border e-commerce transportation,so as to regulate the“Belt and Road”as a guideline.Under such a background,this paper starts from the Rotterdam Rules,considering that the emergence of the rules is a legal system developed in the context of maritime transport e-commerce.While fully drawing on its advantages,this paper also starts from the existing economic aspects to explore the construction and development of Chinese cross-border e-commerce transport legal system.
