摘要
近年来,电信诈骗犯罪频发。相较普通诈骗罪,电信诈骗犯罪表现出犯罪场域国际化,法益侵害多样化,犯罪主体低龄化的特点,致使公安、司法机关在打击电信诈骗犯罪时面临防范难,侦破难,取证难,追赃难等诸多困境。因而构建电信诈骗防控机制,完善立法缺位对于规制电信诈骗犯罪有一定的意义。
In recent years,telecommunications fraud has been frequent.Compared with ordinary fraud crimes,telecommunications fraud crimes are characterized by the internationalization of crime fields,diversification of legal interests,and the aging of criminal subjects.Public security and judicial agencies have difficulties in preventing,detecting,obtaining evidence,and recovering stolen goods when cracking down on telecommunications fraud crimes.Therefore,constructing a telecommunications fraud prevention and control mechanism and improving the absence of legislation have certain significance in regulating telecommunications fraud crimes.
