法律的真理问题乃是关涉共同体生活秩序如何生成与变革的实践哲学问题。正义作为表达法律真理的核心概念,揭示了人类生存秩序得以建立和维护的最深刻的人性根源,其本身就处于经验生活之中。法律语言应是公众都可以参与言说、讨论和交流的公共语言,实践性的公共关系才是其自身的规定性。作为型构共同体生活秩序的规范体系,法律融贯了人们鲜活的生命感、历史感和正义感;在立法、执法、司法、守法等法律实践过程中,人们努力寻求和实现的应是生命规范与社会规范的平衡,由此展现在正义目标引领之下的生命价值和意义。生命的正义感既向历史说话,也向未来召唤;这意味着法律实践既是对传统的拥有,也是对未来的开放,法律秩序因此而呈现为历史与未来作为合体的现实的文明型态,在回首历史并向着未来开放的实践中成就法律自身的权威。

The problem of the truth of law is a practical philosophic one concerning the ways how the order of the community life comes into existence and transforms. As the essential concept expressing the truth of law, justice reveals the deepest root of humanity owing to which the human existential order builds and sustains,and justice itself just exists in the experiential life. The legal language should be public,which the community can participate in use, discussion and communication. A kind of practical public relationship is the definitive property of the legal language itself. As the system of norms shapes and constructs the order of the community life, law contains and blends the lively sense of living, history and justice of people.During the legal practical processes such as legislation, law enforcement, judiciary, law observance,what people strive to achieve and realize should be the balance between the norms of life and social, unrolling the value and meaning of life under the guidance of the aim of justice. The life sense of justice speaks to the past as well as summons the future, which means that the legal practices own the tradition as well as open for what is to come. Then the legal order appears to be a realistic civilizational form integrating the history and the future, accomplishing the authority of its own in the practices retrospecting the history and opening to the future at the same time.
