突发公共卫生事件中个人信息的保护

The Protection of Personal Information in Public Health Emergency

信息时代的到来在充分发挥个人信息价值的同时,也给个人信息带来了严重的安全威胁。虽然我国已从技术、市场、法律等方面明确提出了个人信息保护的要求和手段,但在公共卫生事件突发时,个人信息安全问题激化,针对个人信息保护与价值利用之间的具体关系,我国现有的相关认定标准和评估依据仍需深入细化,应在广泛借鉴国外在个人信息保护方面的优秀经验的基础上,结合国内现状提出个人信息在技术保护、市场保护和法律保护三个视角下的解决路径。

The arrival of the information age brings the value of personal information into both full play and serious security threats.Although China has clearly puts forward the requirements and means of personal information protection from the aspects of technology,market and law,when public health incidents happen,the personal information security problems intensify.In view of the specific relationship between personal information protection and value utilization,China’s existing relevant identification standards and evaluation basis still need to be further refined,which should be widely used for reference in foreign personal information protection On the basis of the excellent experience in nursing,combined with the current situation in China.This paper puts forward the solution path of personal information from the perspectives of technology protection,market protection and legal protection.
