中国特色社区矫正社会工作服务体系研究--基于“社区矫正法”的要求

The Conception of the Community Correction Social Work Service System with Chinese Characteristics--Based on the requirements of the Community Correction Law

《社区矫正法》的颁布为中国特色社区矫正社会工作服务体系的构建提供了法律依据。回顾社区矫正社会工作的发展进程,发现社区矫正社会工作服务在获得承认并取得了巨大的成效的同时,仍面临着专业自主、社会认同、服务有效等的挑战。鉴于《社区矫正法》的相关法律条文在社区矫正社会工作目标、制度内容和主要职责等方面的规定已经明确,本文试图从国家治理体系和治理能力现代化的视域,围绕社会政策、政府购买服务、社会服务内容方法流程、部门协同、质量监督及服务保障等方面,勾画社区矫正社会工作服务体系的基本框架。社区矫正社会工作服务体系的构建与完善仍需在《社区矫正法》的指导下,在实践中不断总结与反思,通过助力刑事执行的质量提升而得以完成。

The promulgation of the Community Correction Law provided a legal basis for the construction of a Community Correction Social work service system.Reviewing the development process of Community Correction Social work,it’s found that while Community Correction Social work service has been recognized and achieved great results,it still faced the challenges of professional autonomy,social recognition and effective service.In viewed of the fact that the relevant legal provisions of the Community Correction Law have specified the goals,system content and main duties of Community Correction Social work,This paper attempted to outline the basic framework of the community correction social work service system from the perspective of the national governance system and modernization of governance capabilities,focusing on social policies;government purchase services;social services content,method,flow;department coordination;quality supervision and service assurance.The construction and improvement of the community correction social work service system still needs to be continuously summarized and reflected in practice under the guidance of the Community Correction Law,which can be completed by promoting the improvement of the penalty enforcement system and the quality improvement of penalty enforcement.
