地方环境教育专门立法的省思

Reflections on the Special Legislation of Local Environmental Education

地方环境教育专门立法具有现实的必要性,它是落实国家环境治理策略的客观需要,是弥补环境教育立法不足的现实必然,也是发挥环境教育地方特色的本质要求。地方环境教育专门立法存在数量较少、制度架构存重大缺陷、地方特色体现不够等问题,其原因主要是环境教育上位法缺失、环境教育立法认知滞后和地方环境治理能力不足。当前,应从增强环境教育立法的理念、坚持"法典化专门立法"的模式、完善核心制度和彰显地方特性等方面加以改进和完善。

The special legislation of local environmental education is necessary.It meets the need of implementing national environmental governance strategy,makes up for the lack of environmental education legislation and develops the local characteristics of environmental education.There are some problems in the special legislation of local environmental education,such as a small number,major defects in the institutional framework,and insufficient expression of local characteristics.The main reasons are the following:lacking of superior law of environmental education,poor cognition cognition of environmental education legislation and insufficient ability of local environmental governance.At present,we should strengthen the concept of environmental education legislation,adhere to the mode of"special legislation of codification",improve the core system and highlight local characteristics.
