检察机关支持起诉的权利与义务——以民事公益诉讼为视角

The Right and Obligation of Procuratorial Organ to Support Prosecution--From the Perspective of Civil Litigation of Public Interest

检察机关作为我国民事公益诉讼的坚强后盾,在提起民事公益诉讼的组织和个人背后给予了大量的帮助与支持,随着公益诉讼制度的不断完善,检察机关在民事公益诉中发挥着越来越重要的作用。但是纵观我国法律和司法解释,没有具体可操作的规定,检察机关支持起诉如“空中楼阁”一般,这就导致了实务中各种做法层出不穷。因此,检察机关在民事公益诉讼中的诉讼地位、支持起诉方式、程序等支持起诉的权利与义务方面的规定亟需明确,并制定完整的支持起诉的法律和实施细则。

As the supporter and prosecutor of civil litigation of public interest in our country,the procuratorial organs give great support to other organizations and individuals who initiate civil litigation of public interest.With the continuous improvement of the litigation system of public interest,procuratorial organs play an increasingly important role in civil litigation of public interest.However,throughout the legal and judicial interpretations of our country,there are no specific and operable provisions.Procuratorial organs support prosecution as“castles in the air”,which leads to various confused practices in judicial practice.Therefore,it is necessary to clarify the rights and obligations of procuratorial organs in supporting prosecution in civil litigation of public interest,including their litigation status,supporting prosecution methods,procedures and so on,and formulate complete laws and implementing rules for supporting prosecution.
