绿色原则融入民事裁判的理解与适用

The Understanding and Application of Green Principle in Civil Judgment

绿色原则作为民法的一项新基本原则,对我国生态文明制度建设发挥着重要的私法价值功能。通过对我国司法裁判中绿色原则援引情况的宏观数据分析和微观案件考察,发现绿色原则在司法适用中存在理解偏差、"向一般条款逃逸"、绿色原则肩负分则"重担""类案异判"现象突出的问题。这与裁判理念坚守传统民法认知范式、裁判制度依据不够完善、裁判方法缺乏统一指导等原因有关。在司法适用过程中,应从解释论层面确立绿色原则转介条款的司法定位;从司法论层面发挥案例指导制度的司法保障作用以及适用"四分法"的裁判路径;从立法论层面进行添附制度的有效补充。在以司法实践为导向的方法论指引下,正确理解绿色原则,切实发挥其在司法适用中的真正效用。

As a new basic principle of civil law,the green principle plays an important private law value in the construction of China’s ecological civilization system.The macro data analysis and micro-case investigation of the green principle in China’s judicial rulings find that there exist problems such as deviations in judicial understanding in the application of the green principle, "escaping to general terms",the green principle shouldering the burden of sub-rule",and the phenomenon of "different judgment of similar cases".This is related to reasons that the judgment concept adheres to the traditional civil law cognitive paradigm,the basis of the judgment system is not perfect enough,and the judgment method lacks unified guidance and so on.In the process of judicial application,the judicial positioning of the referral clause of the Green Principles should be established from the level of interpretive theory;play the judicial guarantee function of the case guidance system from the level of judicial theory and the adjudication path to apply the "four-steps";and An effective complement to the addition system from the level of legislative theory.Finally,under the guidance of the methodology based on practice orientation,the green principle is correctly understood,and its true utility in judicial application is effectively exerted.
