摘要
随着车联网技术日趋成熟,未来的新车将搭载通信功能部件已是大势所趋。随着汽车企业与通信企业的合作进一步加深,就汽车企业在使用移动通信技术时所应支付的许可费数额而引发的专利诉讼也随之升高。本文通过17家汽车及通信企业在车联网相关技术分支的全球专利申请情况及全球声称拥有与车辆技术相关的5G标准必要专利量,分析汽车企业在联网汽车产品上市时潜在的知识产权的风险,提出汽车企业应该加大投入力度,更多地研发与车辆相关的先进通信技术,并为应对潜在风险做好充足的知识产权储备。
With the maturity of the Internet of Vehicles technology,it is already a trend that new vehicles will be equipped with communication components.As cooperation between automotive companies and communication companies deepens,patent litigation over the amount of licensing fees automotive companies should pay when using mobile communications technology has also arisen.This paper analyzes the potential risks of intellectual property rights of automotive companies in the launch of connected car products through the global patent application situation of 17 automotive and communication companies in the technology branch related to Internet of Vehicles and the amount of 5 G standards necessary patents claimed to be owned globally.
