扫黑除恶专项斗争是当下刑事司法工作的重点,相较于“黑”,对“恶”的认定与处理一直是法律领域的短板。立法层面没有解决的问题,在实践中更应当谨慎。在认定恶势力犯罪时要紧扣其核心特征、组织特征、手段特征、犯罪活动特征、区域或行业特征、违法犯罪次数特征。在处理恶势力犯罪时,要把握宽严相济的政策,严字当头,谨慎从宽。
