论行政立法听证中相对人抗辩有效性的功能

On the Function of the Validity of Counterpart's Defense in theHearing of Administrative Legislation

相对人在行政立法听证中抗辩的有效性尊重与保障了包括相对人行政抗辩权在内的程序权利实现了程序正义,同时公正合法地排除了相对人的错误抗辩意见,采纳了相对人的正确抗辩意见实现了实体正义。当前,我国行政立法听证中相对人抗辩有效性的保障还存在诸多问题,主要在于对相对人抗辩有效性功能的认识缺乏系统性、深刻性。相对人抗辩的有效性具有实现人性立法、促进行政立法保障人权,实现和谐立法、增强行政立法结果的可接受性以及实现科学立法、促进良善之法的生成等重要功能。

The validity of the defense of counterpart in the administrative legislative hearing respects and guarantees the procedural rights,including the counterpart's administrative defense right,thus realizing the procedural justice and excludes the wrong defense opinion of counterpart fairly and legitimately and adopts the correct defense opinion of counterpart thus realizing the substantive justice.At present,there are still many problems with the protection of the validity of counterpart's defense in the hearing of administrative legislation in our country.The main reason lies in that we lack systematization and profundity for the revelation of the validity function of counterpart's defense.The validity of counterpart defense has important functions of realizing human nature legislation and promoting administrative legislation to protect human rights,realizing harmonious legislation to enhance the acceptability of administrative legislation results,and realizing scientific legislation to promote the generation of good laws and so on.
