在电子商务和经济网状化发展的影响下,时间和空间对商务贸易的影响正在大幅度减弱,参与业务合作的双方当事人往往不在同一个地点或者相近的区域内,在这种情况下,货物的运输、转手就需要物流的帮助。但因为我国城市化的加强,除了部分较为特殊的物流机构,大部分的物流公司需要依赖第三方协助进行运输工作,货物的运输基本是由第三方物流完成。物流公司是合同履行的载体和实现者。不过,因为城市化的发展,大宗物流运输往往很难直接到达客户手中,在这种情况下,即使物流公司也会面临信息不对称的问题,同时需要承担巨大的法律风险,故文中将就在不对称信息下进行第三方物流时所需要承担的法律风险展开分析,并根据分析结果探讨风险的规避措施。

Under the influence of the development of e-commerce and economic network,the influence of time and space on business trade is greatly weakened.The two parties involved in business cooperation are often not in the same place or near area.In this case,the transportation and transfer of goods need the help of logistics.In addition to some special business organizations,most enterprises or self-employed persons do not have their own independent transportation facilities or lines,and the transportation of goods is basically completed by the third-party logistics.Logistics company is the carrier and implementer of contract performance.However,due to the development of urbanization,the bulk logistics transportation is often difficult to reach the customers directly.In this case,even the logistics companies will face the problem of information asymmetry,and need to bear huge legal risks.Therefore,this paper will analyze the legal risks that the third-party logistics needs to bear under the asymmetric information,and discuss the risks according to the analysis results Measures to avoid risks.
