Protection of Characters in Copyright Infringement

著作权的保护问题在"IP热"的当下愈发突出,大量影视、文学作品被曝抄袭的新闻屡见不鲜。但是对作品著作权的保护往往是从整体进行保护,很少关注人物角色的保护,而人物角色现在越来越成为整部作品的价值核心。本文从作品中人物角色保护的角度出发,分析人物角色的概念与构成的要素,从而探讨人物角色在作品中的地位、是否具有保护的价值以及如何进行保护。

Currently,the problem of copyright protection is becoming more and more prominent.It is not uncommon to see numerous disputes on plagiarism of movies,TV programs and literary works.However,the protection of the copyright of a work is often carried out as a whole and little attention is paid to the protection of characters,while characters are increasingly becoming the core value of the whole work.From the perspective of character protection,this paper analyzes the concept and components of characters and discusses the role of the character in the work,the value of character copyright protection and the ways to protect it.
