摘要
依照《合同法》相关规定,买卖不破租赁依旧是目前房屋租赁和买卖的原则,此原则所对应的情况已经与制定伊始之时有较大差别。我国对房屋交易实行登记制度,而能够限制房屋新所有权人行使使用权的租赁权却没有规定必须登记,其任意性较大。新所有权人往往在房屋未交付之前,无法确切得知所购房屋的真实租赁情况。鉴于目前以长期租赁权规避法院执行的情况,以及同样用未被买方知悉的长期租赁权限制买方使用的情况存在,在对不动产统一登记的前提下,有必要对中长期房屋租赁行为做登记效力的规定,采用登记对抗原则来规范买卖后的所有权之使用与租赁权之间的关系。
In according with the relevant provisions of Contract Law,the principle of"sales not devastating lease"is the principle to transaction and lease.Our laws provide real estate transaction must be registered,but the leasehold which could limit the owner of house to use not to register.The new owner of house has not known exactly about the condition for lease before the house deliver.We should not only depend on seller's honesty to protect the interests of the parties.In view of the fact that using the leasehold to sidestep the law or limit the owner's legitimate interests,it is necessary to institute rules to register the medium-and-long term lease,and put the register antagonism to use.
