摘要
在全面推进多元化纠纷解决机制建设的过程中,律师参与调解机制健全与完善,不仅能够更好地服务于纠纷化解,也有助于参与共建共治共享的社会治理事业。如今,独立机构、驻点内镶和弥散型渗透这三种模式成为律师调解的主要形式。与治理现代化的要求相比,律师参与调解机制还存在着一些阻却性因素。为此,有必要从理念更新、立法规制、国家财政支持等路径进行优化,以更好发挥律师在新时代解决社会纠纷和维护社会稳定的功能。
In the comprehensive promotion process of the pluralistic dispute resolution mechanism construction,it is necessary to improve and perfect the lawyer mediation participation mechanism.It is conductive to a better dispute resolution,and a higher co-governance participation in the social governance and sharing process.Currently,there are three chief lawyer mediation participation modes,namely,independent institutions,stagnation inlay and dispersion infiltration.Compared with the modern governance requirements,obstacles still exist in the lawyer mediation participation mechanism.For this reason,it is necessary to optimize the concept renewal path,legislation and regulation,and national financial support.This would result in a better lawyer role in social dispute solution and social stability maintenance in the new era.
