区块链与用户生成内容的版权问题治理研究

Research on Blockchain and the Governance of Copyright Issues of User-Generated Content

本文基于用户生成内容存在极易与原作品版权人产生利益冲突;传统版权制度在调节用户生成内容文化产业模式各方主体之间的利益平衡时失灵,在确权、用权、维权等各环节均存在痛点,制约着互联网文化产业的发展;现有治理模式也存在难以克服的缺陷和弊端等问题,提出区块链治理模式。通过文献研究、比较研究、跨学科研究等方法,论证区块链的适用优势及其治理用户生成内容版权问题的可行性。

The user-generated content is very easy to conflict with the copyright owner of the original work.The traditional copyright system fails in adjusting the balance of interests among the parties involved in the user-generated content culture industry model,and there are problems in all aspects such as confirmation of rights,use rights,and rights protection that restricts the development of the Internet culture industry.The current governance models also have insurmountable shortcomings and drawbacks.Based on the above problems,a blockchain governance model is proposed.Through literature research,comparative research,interdisciplinary research and other methods,the applicable advantages of blockchain and the feasibility of governing the copyright issues of user-generated content are demonstrated.
