摘要
农民住房财产权抵押贷款是解决农村地区多层次的融资需求、推进乡村振兴的重要措施,抵押权的实现是农民住房财产权抵押贷款制度发挥效用的直接体现,而抵押物的处置是抵押权实现中的关键问题。针对抵押权实现中抵押农房处置难度较大的问题,构建科学、合理的农民住房财产权抵押贷款中抵押物处置机制,应根据不同地区逐步扩大抵押物处置受让人范围,根据受让对象的不同实行有针对性的交易规则;创新抵押物处置方式,建立农房强制管理制度;降低抵押物处置成本,优先通过调解处置抵押物;完善抵押物处置风险保障措施,确保抵押物处置的顺利实现。
Mortgage loan of farmers'housing property right is is an important measure to solve the multilevel financing needs of rural areas and promote the rural revitalization.The realization of mortgage is the direct embodiment of the effectiveness of the mortgage system of farmers'housing property rights.The disposal of mortgage is the key problem in the realization of mortgage.In view of the difficulty in the disposal of mortgaged rural houses in the realization of mortgage,a scientific and reasonable mechanism for the disposal of mortgaged property in the mortgage loan of the farmers'housing property right should be established according to the following aspects:expanding the scope of transferee of mortgage disposal according to different regions gradually and implementing targeted transaction rules according to different transferee objects;innovating the mortgage disposal way and establishing the compulsory management system of rural housing;reducing the disposal cost of mortgage and giving priority to the disposal of mortgage through mediation;improving the risk guarantee measures for the disposal of mortgage to ensure the smooth realization of the mortgage disposal.
