Legal Analysis of“Virtual”Forest Carbon Sequestration

森林碳汇原属于森林的自然属性,但因保护环境之所需,可以通过设定权利义务关系而实现其经济价值,从而使森林碳汇具有社会属性。随着技术的发展,通过手机移动APP如支付宝、移动银行、预约挂号平台等,这类森林碳汇在一定程度上均减少了现实中温室气体的排放。考虑到其与传统森林碳汇的不同,可称之为"虚拟"森林碳汇。应在法律上确认"虚拟"森林碳汇的物权属性,鼓励其进入碳排放交易市场,促使每个公民加入温室气体减排行动。这不仅能保护公民的合法财产权,而且能增强公民的环保意识,以促进环境的改善和保障经济社会的可持续、绿色发展。

The forest carbon sequestration is originally the natural attribute of forests,but will have the social attribute by realizing its economic value through the right-obligation relationship establishment because of the need of environment protection.With the technology development,the use of mobile apps such as Alipay,mobile banking and booking platform has reduced the greenhouse gas emissions to a certain extent,which could be considered as a kind of forest carbon sequestration.As it is different from traditional forest carbon sequestration,it can be called"virtual"forest carbon sequestration.The property rights of"virtual"forest carbon sequestration should be legally recognized and encouraged to enter the carbon emission trading market,so that every citizen can participate in reducing greenhouse gas emissions.This can not only protect citizens’legal property rights,but also enhance their awareness of environmental protection,so as to promote the environmental improvement and guarantee the sustainable and green socioeconomic development.
