解释论视角下的行贿罪特殊从宽处罚条款

Special Clause of Lenient Punishment Regarding the Crime of Offering Bribes in the View of Interpretative Theory

《刑法修正案(九)》对行贿罪特殊从宽处罚条款进行了修订,对行贿罪从宽处罚增加了适用条件。基于历史解释、体系解释和目的解释的不同解释方法,适用行贿罪特殊从宽处罚条款应一方面服务于打击贿赂犯罪大局,另一方面起到平衡行受贿量刑的作用,同时标准应尽可能明确以避免放纵行贿犯罪。故此,对该条款中"主动交待"宜虚化处理,"犯罪较轻"应以犯罪可能适用的刑罚为判断标准,对"重大案件"、"重大立功表现"均应作扩大解释。

The Amendments IV to the Criminal Law revised the special clause of lenient punishment regarding the crime of offering bribes(hereinafter referred to as‘the clause’),adding the application conditions to the lenient punishment of the crime of offering bribes.With the methods of historical interpretation,systematical interpretation and purpose interpretation respectively,it concludes that the application of the clause shall serve the purpose of fighting bribery crimes,balancing the sentence between offering bribes and accepting bribes,and avoiding the indulgence of offering bribes with specific applicable standards.Therefore in the clause,the implication of"voluntarily"shall be weaken;"minor offenders"shall be decided by his possible punishment;while"important cases"and"significant meritorious service"shall be interpreted extensively.
