食用菌出口贸易中的法律风险问题

摘要 随着消费市场对食用菌的需求逐年提升,食用菌行业不断发展壮大。为占领更多的市场份额,我国的食用菌企业开始向海外市场拓展。虽然国际化进程不断加快,传统的关税有所降低,有利于食用菌企业的出口,但注重生态环境保护的绿色壁垒制度及随之而来的各种法律风险逐渐成为食用菌出口贸易的拦路石。为降低食用菌出口贸易面临的法律风险,帮助我国的食用菌企业占据更多的国际市场份额,通过分析国际绿色壁垒的内涵及其可能带来的主要法律风险,提出降低我国食用菌出口贸易法律风险的建议。 As the demand for edible fungi in the consumer market increases year by year,the edible fungi industry keeps growing.In order to occupy more market share,China’s edible fungi enterprises began to expand to overseas markets.Although the traditional tariff has been reduced due to the acceleration of the internationalization process,which is beneficial to the export of edible fungi enterprises,the green barrier system focusing on ecological environment and the accompanying legal risks have gradually become the roadblock for the export trade of edible fungi.Therefore,in order to reduce the legal risk of edible fungi export trade and help edible fungi enterprises in China to occupy more international market share,some suggestions were put forward to reduce the legal risk of edible fungi export by analyzing the connotation of international green barriers and the possible main legal risks.
