刑事诉讼活动始于侦查,侦查在刑事诉讼中担任极为重要的角色,但滥用侦查的情况在司法实践中时有发生。这不仅违反刑事诉讼法惩罚犯罪、保障人权的基本原则,还降低了司法机关的公信力。在以审判为中心的时代背景下,文章对侦查活动监督的内涵、外延、遭遇的困境进行实证剖析,探索在现有侦查活动监督机制的基础上如何充分发挥检察机关的法律监督职能,力求侦查活动顺利开展的同时确保犯罪嫌疑人的合法权利免受不法侵害。

Criminal litigation begins from investigation,and investigation plays an extremely important role in criminal proceedings.However,the abuse of investigations occurs in judicial practice,which not only violates the basic principles of punishing crimes and guaranteeing human rights in criminal procedure law,but also reduces the credibility of judiciary authorities.Under the background of trial-centered era,this paper conducts an empirical analysis on the connotations,extension and difficulties encountered in the supervision of investigation activities,and explores how to fully exert the legal supervision function of the procuratorates based on the existing monitoring mechanism for investigation activities,striving to protect the legitimate rights of criminal suspects from illegal infringement while ensuring the smooth development of investigation activities.
