摘要
党的十九大报告中,中央对于房地产市场指明了方向,提出了"租购并举"的住房制度,把"租"的位置放到"购"之前,体现了对租房制度的重视,为规范住房租赁和销售行为,住房城乡建设部起草了《住房租赁和销售管理条例(征求意见稿)》。通过对《条例》(征求意见稿)的探索和解读,分析外部结构和具体内容中存在的立法问题,提出"租购并举"的立法规划、提高立法质量等立法建议。
In the report of the 19 th National Congress of the People’s Republic of China,the central government pointed out the direction of the real estate market and put forward the housing system of developing rent and purchase simultaneously,which lay the position of"rent"ahead of"purchase",reflecting the importance of the rental system.In order to regulate the behaviors of housing lease and sales,Ministry of Housing and Urban-Rural Development drafted Regulations on the Administration of Housing Lease and Sales(Opinion Soliciting Draft).Through the exploration and interpretation of the Regulations,this paper analyzes the legislative problems existing in the external structures and specific contents,and puts forward the legislative planning of developing rent and purchase simultaneously as well as legislative suggestions on the improvement of the legislative quality.
