标准必要专利反垄断规制问题探析

Analysis of the Antitrust Regulation of Standard Essential Patent

近年来,越来越多的中国企业开始开拓海外市场,随之而来的是标准必要专利诉讼案件和反垄断案件的增多,而国内尚未针对标准必要专利的滥用建立独立的反垄断规制体系。文章通过对标准必要专利相关内涵的界定,探讨在《反垄断法》视野下对标准必要专利的规制,指出标准必要专利在标准制定环节和专利许可环节存在的问题。通过分析国内外规制标准必要专利的现状,提出用反垄断法规制标准必要专利滥用的对策。

In recent years,more and more Chinese enterprises have begun to explore overseas markets.Along with this,there has been an increase in standard essential patent litigation cases and antitrust cases,but China has not yet established an independent antitrust regulation system for the abuse of standard essential patents.Through the definition of the relevant connotation of the standard necessary patents,this paper discusses the their regulation in the perspective of the Antitrust Law,and points out the problems of standard essential patents in the process of standard setting and patent licensing.By analyzing the current status of essential patents in domestic and foreign regulatory standards,countermeasures for the abuse of essential patents in antitrust regulatory standards are proposed.
