新土地管理法背景下征地区片综合地价的理论探索 被引量:6

摘要 即将实施的新《土地管理法》规定,征收农用地的土地补偿费和安置补助费通过制定公布区片综合地价确定,这对我国征地补偿制度的改革具有重大意义。如何更好地制定落实征地区片综合地价,是接下来各地政府的一项重要课题。本文在梳理征地补偿制度变迁和典型地方模式的基础上,分析了征地区片综合地价的本质、制定原理、优越性及存在问题。结果表明,征地区片综合地价的本质是政府垄断价格,其具有提高征地补偿标准、实现同地同价、趋向弹性化和考虑了土地增值分配的优越性的优点,同时它也存在一些不足之处,如"不同地同价"隐患、土地价值不明晰、结果科学性存疑和与现实情况不兼容等。针对存在的主要问题,本文从4个方面提出了建议,以期为政府更好落实征地区片综合地价提供参考。 The new law of land administration of the People’s Republic of China to be implemented stipulates that land compensation and arrangement allowance for agricultural land acquisition will be determined through integrated land price for expropriation,which is of great significance to the reform of China’s com-pensation systems for land expropriation.How to better formulate and implement the integrated land price for expropriation is an important issue for governments in various regions.On the basis of combing the changes of the compensation systems for land expropriation and typical local models,this paper analyzes the nature,formulation principles,superiority,and existing problems of integrated land price for expropriation.The results show that the essence of the comprehensive land price of the expropriated area is the government monopoly price,which has the advantages of increasing the compensation standard for land expropriation,achieving the same price at the same place,becoming more flexible,and taking into account the distribution of land value added,at the same time,it also has some shortcomings,such as the hidden dangers of "different prices at the same place",unclear land values,scientifically questionable results,and incompatibility with reality.In view of the main problems,this paper puts forward suggestions from four aspects,in order to provide a reference for the government to better implement the integrated land price for expropriation.
