舆论监督与审判独立关系研究

Research on the Relationship between Supervision by Public Opinion and Independent Trial

近些年,随着我国互联网传媒技术的飞速发展以及公众法律素养提高,舆论监督在司法监督体制中的作用日益凸显,其有效地促进司法公开,遏制司法腐败。然而,在实际案件中,舆论监督也存在对审判独立的干扰,影响法院公正审判。因此,应厘清舆论监督与审判独立之间的关系,从而探析两者之间矛盾的原因,进而找到平衡冲突、解决矛盾的可行路径,维护司法公正和推动我国民主法治建设。

In recent years,with the rapid development of China's Internet media technology and the improvement of public legal literacy,the public opinion supervision plays an increasingly prominent role in the judicial supervision system,which effectively promotes judicial openness and curbs judicial corruption.However,in actual cases,the supervision of public opinion also violates the independence of the trial,which affects the fair trial of the court.Therefore,the relationship between the supervision of public opinion and the independence of trial should be clarified,so as to explore the causes of the contradiction between the two,so as to find a balance between the conflict,the solution to the contradiction,the maintenance of judicial justice and the promotion of the democratic rule of law in China.
