论破产财产网络拍卖规则的构建

Discussion on the Construction of Online Auction Rules for Bankruptcy Property

我国现行破产规范对破产财产网络拍卖规则付诸阙如,实践中管理人多根据网络司法拍卖规则处置破产财产。为规范破产财产网络拍卖行为,防范因不当拍卖造成破产财产价值贬损,有必要针对破产财产拍卖制定专门的网络拍卖规则,规则无须从破产法立法层面规定,建议最高人民法院专门出台司法解释,从破产拍卖主体、拍卖平台遴选机制、竞拍人资格、拍卖参与主体职责、救济规则等方面加以规定。

China's current bankruptcy law does not stipulate the rules of online auction of bankruptcy property.In practice,administrators mostly deal with bankruptcy property according to the rules of online judicial auction.In order to regulate the online auction behavior of bankruptcy property and prevent the depreciation of the value of bankruptcy property due to improper auction,it is necessary to formulate special online auction rules for bankruptcy property.However,it is not necessary to formulate that from the legislative level of bankruptcy law.It is suggested that the Supreme People's Court could issue a special judicial interpretation from the aspects of bankruptcy auction subject,the selection mechanism of the auction platform,bidder qualifications,the duties of the participants and relief rules.
